Terms of Service

1. Acceptance of Terms

By accessing or using DXSense AI ("the Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These Terms form a binding agreement between you (or the organisation you represent) and DXSense AI.

2. Service Description

DXSense AI provides an autonomous penetration testing platform that plans. Executes. Reports on authorised security assessments against targets you own or have explicit written permission to test. The Platform includes autonomous software. Security tooling. Evidence collection. Reporting.

3. Authorisation and Scope

You represent and warrant that, for every engagement you launch, you have full legal authority to test the defined scope. You are solely responsible for obtaining and retaining written authorisation from asset owners. You must not direct the Platform at systems you do not own or lack permission to test. Violations may be reported to law enforcement.

4. Acceptable Use

  • No testing of third-party infrastructure without written consent.
  • No use of the Platform for denial-of-service, data theft, or extortion.
  • No attempts to bypass Platform authorisation or safety controls.
  • No sharing of credentials, API keys, or account access.

5. Billing and Payments

Paid plans are billed by our authorised payment processors. Fees. Allowances. Outcome-based charges. All disclosed on the pricing page and in your billing history. Charges are non-refundable except as stated in our Refund Policy. You are responsible for all applicable taxes.

6. Intellectual Property

The Platform and its underlying software are the property of DXSense AI. You retain ownership of your engagement data. Findings. Reports. We retain a limited licence to process your data solely to deliver the service.

7. Disclaimers

The Platform is provided on an "as-is" and "as-available" basis. We do not warrant that findings are exhaustive or that all vulnerabilities will be discovered. Security testing is inherently imperfect; you remain responsible for the overall security of your systems.

8. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Platform is limited to the fees paid by you in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Termination

We may suspend or terminate your access for breach of these Terms, suspected unauthorised testing, or non-payment. You may cancel at any time from your account settings. Obligations that by their nature should survive termination will survive.

10. Governing Law

These Terms are governed by the laws of India. Disputes will be resolved in the courts of Bengaluru, Karnataka, unless otherwise required by applicable consumer law.
